Joe Biden Says That President Trump Nominating a New SCOTUS Justice “Defies Every Precedent”

Posted by

Speaking at a press event, Joe Biden spoke about the passing and dying wish of Justice Ruth Bader Ginsburg she told her granddaughter before she died. Ginsburg purportedly said that it was her most “fervent wish” that a new justice not be installed until a new President has been elected.

Biden said that her wish was not a favor or personal request but her last act of standing up for American democracy. He continued to say, “Never before in our nation’s history has a Supreme Court justice been nominated and installed while a presidential election is already underway. It defies every precedent.”

He also said that it defies the rule of law and that by nominating a new Justice is a threat to the Affordable Care Act and that the Trump Administration has found a loop hole through Ginsburg’s death to do so.

Joe Biden is clearly mistaken here. What precedent is he referring to? The precedents outlined in the Constitution that a President shall nominate a new Supreme Court Justice when a vacancy occurs. Joe Biden even said so himself in 2016. He’s right when he said that Trump is trying to repeal the Affordable Care Act because Trump does plan to reverse the flawed legislation that hasn’t helped Americans like Obama promised it would.

Joe Biden thinking that President Trump doing his job “defies every precedent” then obviously the former Vice President has no understanding of the Constitution and what it takes to be President of the United States.
